1. Scope and contracting party

These terms apply to purchases of goods by consumers through the MONATLICH. online shop. Your contracting party is:

A consumer is a natural person acting predominantly for private purposes. Individual agreements and mandatory statutory rights remain unaffected.

2. Our vintage pieces

We mainly sell pre-owned clothing and one-of-a-kind pieces. Condition, size, measurements, materials and visible signs of wear are described in the individual listing and product images. Many pieces are available only once. Adding an item to your shopping bag does not reserve it.

A product’s pre-owned nature does not generally limit your statutory rights concerning defects. Deviations from objective statutory requirements require a separate express agreement where required by law. A general reference to “vintage” or “second-hand” does not replace such an agreement.

3. Orders and conclusion of the contract

Product listings are an invitation to place an order. You can select items, review your shopping bag and amend your details or selection before completing the order. Clicking the final order button, clearly labelled to indicate an obligation to pay, submits a binding offer to purchase.

We accept your offer by sending an order confirmation email or dispatching the goods. A message expressly confirming only receipt of an order is not acceptance. If we initiate the final charge to your payment method beforehand, this already constitutes acceptance. The contract is concluded in English.

Please save the order information and terms applicable to your purchase for your records. You can use your browser’s print or save function to retain these pages. If you have questions about your order, contact us by email.

4. Prices and payment

Prices displayed in the shop are total prices in euros. Any additional shipping costs are displayed before the binding order is placed. The total shown at that point applies. Details are available under Shipping & payment.

You can choose from the payment methods offered at checkout. Payment is initiated when the order is completed in accordance with the selected payment method’s terms. The goods remain our property until they have been paid for in full.

5. Delivery

We initially deliver only to addresses in Germany. Unless stated otherwise in a listing, delivery takes 3–5 working days from conclusion of the contract or, where advance payment has been agreed, from receipt of payment. Working days here mean Monday to Friday, excluding public holidays.

For delivery to consumers, we bear the transport risk until the goods are handed to you or a person you have designated to receive them. The statutory exception for a carrier independently appointed by you and not previously named by us remains unaffected.

6. Right of withdrawal

Consumers have a statutory right of withdrawal. For goods, the period is generally 14 days from receipt. Details, the return address and a model form are provided in our Right of withdrawal information.

7. Defects and liability

Statutory rights concerning defects apply. These terms do not exclude or shorten those rights, including for pre-owned items. An additional guarantee exists only where expressly stated for the particular item. Our liability is governed by the applicable statutory provisions.

8. Dispute resolution and applicable law

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

German law applies. The protection afforded by mandatory provisions of the country in which you habitually reside remains in place where applicable. Statutory places of jurisdiction are not restricted.
